These Terms of Service ("Terms") govern your access to and use of the website at slingshot.timm.work and the products and services offered by Slingshot Academy, a service of Chiusano & Daughter LLC, operated by Timm Chiusano ("Slingshot Academy," "we," "us," or "our"). By using the site or services, you agree to these Terms. If you do not agree, do not use the site or services.
1. Eligibility
You must be at least eighteen years old and capable of forming a binding contract to use the site or purchase services. By using the site, you represent that you meet these requirements.
2. Services
Slingshot Academy offers, among other things:
- Cohort-based coaching programs led by Timm Chiusano covering leadership, management, and executive development topics.
- One-on-one coaching available by application to qualifying participants.
- Live sessions, workshops, and Q&A calls for enrolled participants.
- Educational content, recordings, written materials, and related resources.
Coaching content reflects Timm Chiusano's professional experience and opinions. It is provided for informational and educational purposes and is not a substitute for licensed therapy, medical advice, legal counsel, or financial planning.
3. Purchase and payment
When you purchase a service:
- Prices are displayed at checkout in United States dollars.
- Payment is processed by a third-party payment provider. By submitting payment information, you authorize the provider to charge the amount shown.
- Payment is due in full at checkout unless otherwise noted.
- You are responsible for any taxes applicable in your jurisdiction.
4. Refund policy
Because cohort spots are limited and program access is granted on enrollment, purchases are non-refundable except where required by law or where Slingshot Academy fails to deliver the program. If you believe a refund is warranted, email [email protected] within seven days of purchase with the details.
5. Scheduling and rescheduling
If you cannot attend a scheduled live session, contact us at least twenty-four hours in advance to be added to a future session where available. Missed sessions without notice are not eligible for refunds. Recordings may be made available at our discretion.
6. Communications
By creating an account or purchasing a service, you consent to receive transactional communications by email (order confirmations, calendar invites, program access information, session reminders, customer support). You may opt in to promotional SMS communications via the checkout or contact form. You may opt out of promotional communications at any time. See our Privacy Policy for details.
7. License to use the site
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the site and use the services for your personal, non-commercial use.
8. Intellectual property
All content on the site (text, graphics, logos, recordings, course materials, and the like) is owned by Slingshot Academy, its licensors, or contributors, and is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, publish, modify, or create derivative works of any content without written permission.
9. User-generated content
If you post comments, questions, or any other content during a session or in connection with our services, you grant Slingshot Academy a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content for the purposes of operating and promoting the services. You represent that the content you submit is yours to submit and does not violate the rights of any third party.
10. Acceptable use
You agree not to:
- Use the site or services for any unlawful purpose.
- Share or resell access to paid services without authorization.
- Record or redistribute any live session, recording, or course material without written permission.
- Interfere with the operation of the site or attempt to access systems you are not authorized to access.
- Submit false information at checkout or impersonate any person.
11. Disclaimers
Slingshot Academy provides coaching and educational services. Nothing on the site or in any session constitutes medical, mental-health, legal, financial, or other professional advice. The services are not a substitute for licensed therapy or counseling.
The site and services are provided "as is" and "as available," without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure.
12. Limitation of liability
To the maximum extent permitted by law, Slingshot Academy and its operator, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the site or services. Our aggregate liability for any claim arising out of or related to these Terms or the services will not exceed the amount you paid us in the twelve months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Slingshot Academy and its operator, officers, employees, contractors, and agents from any claim, damage, loss, liability, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the site or services, or your violation of any law or third-party right.
